AI & Intellectual Property Policy

1. Content Ownership

You retain all rights, title, and interest in any content you upload to PrismUp, including but not limited to product photographs, brand assets, logos, and reference images ("User Content").

All images, visuals, and other materials generated by PrismUp's AI on your behalf ("Generated Content") are owned by you. PrismUp claims no ownership, copyright, or any other intellectual property rights over Generated Content. You are free to use, modify, distribute, license, and commercially exploit Generated Content without restriction.

2. License to Process

By uploading User Content to PrismUp, you grant İlk Adım Elektronik Tic. ve Aksesuar San. Ltd. Şti. Ticaret A.S. a limited, non-exclusive, non-transferable, revocable license to:

• Process, transform, and transmit your User Content solely for the purpose of delivering the PrismUp service to you.
• Temporarily store your User Content on our infrastructure and on the infrastructure of our sub-processors as necessary for image generation.

This license is strictly limited to service delivery. It is automatically revoked when you delete the relevant content from your account or when your account is terminated, whichever occurs first.

3. No Training Use

PrismUp does not use your User Content or Generated Content to train, fine-tune, or otherwise improve any artificial intelligence or machine learning models. This applies to both our own systems and any third-party models we utilize.

Your data is processed exclusively to fulfill your generation requests and is not aggregated, anonymized, or repurposed for model development of any kind.

4. Third-Party AI Models

PrismUp utilizes third-party AI models, including Google Gemini and OpenAI, to power image generation and content analysis features. When you use PrismUp, your User Content may be transmitted to these providers solely for processing your requests.

We maintain contractual agreements with our AI providers that include the following protections:

• Your content is not used by these providers to train their general-purpose models.
• Your content is processed under API terms of service that provide enterprise-grade data handling commitments.
• We regularly review provider terms to ensure continued compliance with this policy.

Your use of PrismUp is also subject to the terms of service of these third-party providers insofar as they apply to end users. We recommend reviewing the relevant provider policies for additional detail.

5. Generated Content Uniqueness

AI-generated outputs are produced by statistical models and are not guaranteed to be unique. Different users who provide similar inputs, reference images, or prompts may receive similar or visually comparable outputs.

PrismUp does not warrant that Generated Content will be distinct from content generated for other users, nor that it will be free from resemblance to existing works. You are responsible for evaluating the suitability and originality of Generated Content before using it in commerce or publication.

6. DMCA / Takedown

If you believe that content available on or generated through PrismUp infringes your intellectual property rights, please contact us at ip@prismup.ai with the following information:

• A description of the copyrighted work or intellectual property you claim has been infringed.
• The URL or location of the allegedly infringing content on PrismUp.
• Proof of your ownership or authorization to act on behalf of the rights holder.
• A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or the law.
• Your contact information (name, address, email, phone number).

We will review all valid takedown requests and respond within five (5) business days. If the claim is substantiated, the infringing content will be promptly removed or access to it will be disabled.

7. Indemnification

You represent and warrant that you have all necessary rights, licenses, and permissions to upload User Content to PrismUp, and that such content does not infringe or misappropriate the intellectual property rights of any third party.

You agree to indemnify, defend, and hold harmless İlk Adım Elektronik Tic. ve Aksesuar San. Ltd. Şti. Ticaret A.S., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your User Content, including any claims that it infringes third-party intellectual property rights.
• Your use of Generated Content in a manner that gives rise to third-party claims.
• Your breach of this AI & Intellectual Property Policy.
